These Terms of Service (“Terms”) govern your access to and use of the website and services provided by Akara (“Akara,” “we,” “us”). By accessing the Service, joining the waitlist, or otherwise using our website, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old and legally able to enter into a contract to use the Service. You are responsible for complying with all laws that apply to you, including those governing crypto assets in your jurisdiction.

2. What Akara is (and is not)

Akara provides software that lets users configure risk guardrails and receive AI-generated research and trade proposals. Akara is in early access, and live exchange execution is rolling out in stages. Where live execution is available it is supervised first — the agent proposes and you approve. When connected to an exchange, Akara operates non-custodially and never takes custody of your funds.

Akara is a technology provider, not a broker, exchange, investment adviser, or financial advisor. Nothing in the Service constitutes financial, investment, legal, or tax advice, or a recommendation or solicitation to buy or sell any asset.

3. Assumption of risk

Trading crypto assets involves substantial risk of loss and is not suitable for every person. Any performance shown may be hypothetical or based on historical or test conditions, has inherent limitations, and does not guarantee future results. AI outputs may be inaccurate, incomplete, or unsuitable for your circumstances. You are solely responsible for the rules, guardrails, and any decisions you make. You use the Service at your own risk.

4. Your account and conduct

You agree to provide accurate information and to keep any credentials secure. You agree not to:

  • Use the Service for any unlawful, fraudulent, or abusive purpose;
  • Attempt to disrupt, reverse engineer, or gain unauthorized access to the Service or its systems;
  • Scrape, resell, or misuse data or model outputs; or
  • Violate the rights of others or applicable law.

5. Intellectual property

The Service, including its software, models, design, and content, is owned by Akara or its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose. All rights not expressly granted are reserved.

6. Third-party services

The Service may integrate with or link to third-party services (for example, exchanges, market-data providers, or hosting). We are not responsible for third-party services, and your use of them is governed by their own terms.

7. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or that any result or proposal will be accurate or profitable.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AKARA AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR TRADING LOSSES, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. Because the Service is currently provided free of charge during early access, our total liability for any claim will not exceed one hundred US dollars (USD 100).

9. Indemnification

You agree to indemnify and hold Akara harmless from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the Service or your violation of these Terms or applicable law.

10. Changes and termination

We may modify, suspend, or discontinue the Service at any time. We may update these Terms by posting a revised version with a new “Last updated” date; your continued use means you accept the changes. We may suspend or terminate your access if you violate these Terms.

11. Governing law & disputes

If a dispute arises, please contact us first at [email protected] so we can try to resolve it informally and in good faith. Nothing in these Terms waives any mandatory rights you have under the laws of your place of residence. We will designate a specific governing law and venue in an updated version of these Terms once our legal entity is established.
